These Terms of Service (“Terms”) govern your access to and use of Physique AI, including our website, mobile or web application, body scan features, AI-assisted analysis, progress tracking tools, AI Coach, subscriptions, and related services.

By creating an account, purchasing a subscription, uploading photos, or using Physique AI, you agree to these Terms.

If you do not agree, do not use Physique AI.

1. About Physique AI

Physique AI is a fitness technology app that provides AI-assisted body composition estimates, progress tracking, scan history, and coaching tools.

Users may upload progress photos and provide profile information to receive estimated body composition reports and personalized fitness insights.

Physique AI is not a medical device, healthcare provider, diagnostic service, or substitute for professional medical advice.

2. Eligibility

You must be at least 13 years old to use Physique AI.

If you are under 18, you may use Physique AI only with the consent and supervision of a parent or legal guardian.

By using Physique AI, you represent that you meet these eligibility requirements.

3. No Medical Advice

Physique AI does not provide medical advice, diagnosis, treatment, or healthcare services.

The app’s body composition estimates, AI Coach responses, fitness insights, and progress analysis are for general informational and fitness purposes only.

You should not rely on Physique AI for:

  • Medical diagnosis
  • Medical treatment
  • Disease prevention
  • Eating disorder management
  • Mental health treatment
  • Body dysmorphia treatment
  • Injury rehabilitation
  • Pregnancy-related decisions
  • Medication, supplement, or clinical decisions
  • Any urgent or emergency health concern

Always consult a qualified healthcare professional before making significant changes to your diet, exercise routine, weight-loss plan, supplement use, or health behavior.

If you have a medical emergency, call emergency services immediately.

4. AI Estimates May Be Inaccurate

Physique AI uses artificial intelligence to generate body composition estimates. These estimates may include estimated body fat percentage, lean mass, fat mass, BMI, progress trends, and related insights.

You understand and agree that AI-generated results may be inaccurate, incomplete, inconsistent, or misleading.

Results may be affected by:

  • Lighting
  • Camera angle
  • Pose
  • Clothing
  • Pump, hydration, food intake, or bloating
  • User-provided height, weight, age, or sex
  • Photo quality
  • Recent weight fluctuations
  • AI model limitations
  • Technical errors
  • Calibration errors

Physique AI does not guarantee accuracy. You should treat results as estimates, not precise measurements.

5. User Responsibility

You are responsible for:

  • Providing accurate account and profile information
  • Uploading appropriate photos
  • Using the app safely and responsibly
  • Understanding that results are estimates
  • Consulting professionals when needed
  • Maintaining the confidentiality of your account
  • All activity that occurs under your account

You should not use Physique AI in a way that encourages unsafe weight loss, disordered eating, obsessive body checking, self-harm, or harmful fitness behavior.

6. Account Registration

To use certain features, you may need to create an account.

You agree to provide accurate information and keep your account information up to date.

You are responsible for protecting your login credentials. Notify us immediately at support@myphysiqueai.com if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms, create security risks, or misuse the service.

7. Uploaded Photos and User Content

You may upload photos, profile information, messages, goals, and other content to Physique AI (“User Content”).

You retain ownership of your User Content.

By uploading User Content, you grant Physique AI a limited license to use, process, store, display, analyze, and transmit that content as necessary to:

  • Provide the app’s features
  • Generate body composition estimates
  • Display scan history and progress
  • Provide AI Coach responses
  • Maintain security
  • Debug and improve the service
  • Comply with legal obligations

You represent that you have the right to upload any content you provide.

You may not upload content that is unlawful, abusive, exploitative, sexually explicit, invasive of another person’s privacy, or otherwise inappropriate for the service.

8. Body Scan Photos

Body scan photos are intended for personal fitness progress analysis. You should only upload photos of yourself.

Do not upload photos of another person without their consent.

Do not upload nude, sexually explicit, exploitative, or illegal images.

Physique AI may restrict, remove, or refuse to process content that violates these Terms or creates safety, privacy, or legal risks.

9. AI Coach

The AI Coach provides general fitness and lifestyle information based on the information you provide.

AI Coach responses may be inaccurate, incomplete, or unsuitable for your personal circumstances.

The AI Coach is not a doctor, registered dietitian, therapist, trainer, or licensed healthcare professional.

You are responsible for evaluating all AI Coach responses and consulting qualified professionals before acting on advice related to health, nutrition, exercise, injury, or medical concerns.

10. Subscriptions and Billing

Physique AI may offer paid subscription plans, including monthly or other recurring subscriptions.

By purchasing a subscription, you authorize Physique AI and its payment processor to charge your selected payment method on a recurring basis until you cancel.

Subscription features, limits, and prices may vary by plan and may change over time.

Payments are processed by Stripe or another third-party payment processor. Your payment information is subject to the payment processor’s terms and privacy policy.

11. Subscription Plans and Usage Limits

Subscription plans may include limits on scans, AI Coach messages, saved plans, downloads, exports, or other features.

We may enforce reasonable usage limits, fair-use rules, abuse prevention rules, or technical restrictions to protect the service and prevent excessive or harmful use.

“Unlimited” features, if offered, may still be subject to fair-use limits, abuse prevention, technical limitations, and account restrictions.

12. Cancellations

You may cancel your subscription through your account settings, Stripe customer portal, app store subscription settings, or another cancellation method provided in the app.

Cancellation prevents future renewals but does not necessarily provide a refund for the current billing period.

You will generally retain access to paid features until the end of the current paid billing period unless otherwise stated.

13. Refunds

Refunds are handled case-by-case unless required by law.

We are not obligated to provide refunds for partial billing periods, unused features, failure to cancel before renewal, dissatisfaction with AI estimates, or changes in personal circumstances.

To request a refund, contact support@myphysiqueai.com.

If you purchased through an app store, refunds may be handled by the app store according to its policies.

14. Free Trials and Promotions

Physique AI may offer free trials, discounts, promotional pricing, or limited-time access.

Promotions may be modified, limited, or discontinued at any time.

If a free trial converts into a paid subscription, you may be charged unless you cancel before the trial ends.

15. Acceptable Use

You agree not to:

  • Use Physique AI for unlawful purposes
  • Upload content that violates another person’s rights
  • Upload photos of others without consent
  • Attempt to access another user’s account or data
  • Reverse engineer, scrape, copy, or exploit the service
  • Interfere with security features
  • Bypass subscription limits or usage restrictions
  • Use automated systems to overload the service
  • Misrepresent AI-generated results as medical or professional measurements
  • Use the service to create harmful, abusive, or exploitative content
  • Attempt to manipulate billing, roles, entitlements, or permissions
  • Use Physique AI in a way that promotes self-harm, eating disorders, or unsafe behavior

16. Intellectual Property

Physique AI, including its name, branding, interface, design, software, features, text, graphics, logos, and underlying technology, is owned by PHYSIQUE AI LLC or its licensors.

These Terms do not grant you ownership of any Physique AI intellectual property.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Physique AI unless expressly permitted by us in writing.

17. Service Availability

We may modify, suspend, or discontinue any part of Physique AI at any time.

We do not guarantee that the app will always be available, error-free, uninterrupted, secure, or compatible with every device or browser.

We may perform maintenance, updates, or security changes that temporarily affect availability.

18. Beta Features

Some features may be experimental, in beta, or still being improved.

Beta features may be inaccurate, unstable, incomplete, or removed at any time.

By using beta features, you accept the risk that they may not work as expected.

19. Third-Party Services

Physique AI may rely on third-party services, including hosting providers, database providers, payment processors, AI providers, analytics tools, email providers, and app platforms.

We are not responsible for third-party services, outages, errors, terms, privacy practices, or security incidents outside our reasonable control.

Your use of third-party services may be subject to separate terms and privacy policies.

20. Privacy

Your use of Physique AI is also governed by our Privacy Policy, which explains how we collect, use, share, and protect information.

By using Physique AI, you agree to the Privacy Policy.

21. Data Deletion

You may request deletion of your account or certain personal data by contacting support@myphysiqueai.com.

Some information may be retained where necessary for legal, billing, security, backup, fraud prevention, dispute resolution, or legitimate business purposes.

22. Disclaimers

Physique AI is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of accuracy, fitness for a particular purpose, merchantability, non-infringement, availability, and reliability.

We do not guarantee that:

  • AI estimates will be accurate
  • Fitness insights will be appropriate for you
  • The app will produce specific health, fitness, weight-loss, or body composition results
  • The app will be uninterrupted or error-free
  • Data will never be lost or accessed without authorization
  • Any issue will be corrected immediately

23. Limitation of Liability

To the fullest extent permitted by law, PHYSIQUE AI LLC and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, personal injury, emotional distress, fitness setbacks, business interruption, or loss of goodwill.

To the fullest extent permitted by law, our total liability for any claim related to Physique AI will not exceed the amount you paid to Physique AI in the three months before the event giving rise to the claim, or $100, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

24. Indemnification

You agree to indemnify and hold harmless PHYSIQUE AI LLC and its owners, employees, contractors, service providers, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your use of Physique AI
  • Your violation of these Terms
  • Your User Content
  • Your violation of another person’s rights
  • Your misuse of AI-generated results
  • Your violation of law

25. Termination

We may suspend or terminate your access to Physique AI at any time if we believe you violated these Terms, created risk for the service, abused the platform, failed to pay subscription fees, or used the app in a harmful or unlawful way.

You may stop using Physique AI at any time.

Termination does not automatically entitle you to a refund.

26. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify you by updating the effective date, posting a notice in the app, or contacting you by email.

Your continued use of Physique AI after updated Terms are posted means you accept the updated Terms.

27. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Any disputes will be handled in the state or federal courts located in Florida, unless applicable law requires otherwise.
